Welcome to Slow the Spiral ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of slowthespiral.co (the "Site") and any purchases made through it. Slow the Spiral is powered by Shopify, which enables us to provide our services to you. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old to make a purchase on this Site. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and current.
2. Products
We sell handmade candles and related lifestyle goods. Please note:
Handmade Variation: Because our candles are handmade in small batches, slight variations in color, scent throw, and appearance between items are normal and not considered defects.
Candle Safety Warning: Always burn candles within sight, away from drafts, flammable materials, children, and pets. Trim wicks before each use. Never leave a burning candle unattended. Discontinue use when approximately ½ inch of wax remains. We are not responsible for damage, injury, or loss resulting from improper use or failure to follow burning instructions.
Fragrance & Allergen Disclosure: Our candles contain fragrance oils. If you have known sensitivities or allergies to fragrance, essential oils, or specific scent compounds, please review ingredient information before purchasing or contact us with questions. We are not liable for allergic reactions resulting from product use.
Product Descriptions: We strive for accuracy in all product descriptions, images, and pricing, but we do not warrant that this content is error-free, and colors or appearance may differ depending on your device's display. We reserve the right to correct errors and update information, or discontinue or limit any product, at any time without prior notice.
3. Orders & Payment
When you place an order, you are making an offer to purchase. All orders are subject to acceptance and availability, and your order is not accepted until we confirm acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or inventory issues. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted.
Prices are listed in U.S. Dollars and are subject to change without notice. Applicable sales tax will be calculated and added at checkout where required.
Payment is processed through our third-party payment provider(s) via the Site. By submitting payment information, you represent that you are authorized to use the payment method provided, and that the information you provide is true, correct, and complete.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
4. Shipping
We currently ship within the United States.
Estimated shipping and processing times are provided for convenience and are not guaranteed. We are not responsible for carrier delays or for orders shipped to an incorrect address provided at checkout. Risk of loss and title for products pass to you upon our delivery to the shipping carrier.
5. Returns & Refunds
Until a final policy is published, please contact us directly at info@slowthespiral.co with any order issues, and we will address them on a case-by-case basis. We reserve the right to update this section at any time; the version in effect at the time of your purchase will govern that order.
6. Intellectual Property
All content on this Site — including but not limited to the Slow the Spiral name, logo, product names, photography, graphics, and written content — is the property of Slow the Spiral and is protected by applicable intellectual property laws. These Terms permit you to use the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, or otherwise use any Site content for commercial purposes without our prior written consent. Shopify's name, logo, and trademarks belong to Shopify; all other third-party names, logos, and trademarks on the Site belong to their respective owners.
7. Optional Third-Party Tools
We may provide access to tools or features offered by third parties as part of the Site, which we do not control or monitor. Such tools are provided "as is" without warranties of any kind, and any use of them is at your own risk. Please review the relevant third party's own terms before using such tools.
8. User Conduct
When using the Site, you agree not to:
- Violate any applicable law or regulation
- Submit false or misleading information
- Attempt to interfere with the security or proper functioning of the Site
- Use the Site to transmit harmful code or engage in fraudulent activity
- Use any robot, scraper, or automated data-gathering tool to access the Site, except as permitted under Section 9 below
We reserve the right to suspend or terminate your access to the Site for any violation of these Terms.
9. AI Agents & Automated Access
If you use, enable, or deploy any automated or AI-driven software ("Agent") to access or interact with the Site on your behalf, that Agent must clearly identify itself as non-human in its requests, must not attempt to disguise itself as a human user or bypass measures intended to distinguish human from automated traffic, and must respond truthfully if asked whether it is an Agent. We reserve the right to limit, block, or restrict Agent access to the Site at our discretion.
10. Relationship with Shopify
Slow the Spiral is powered by Shopify, which enables us to provide our services to you. Any sales and purchases you make through this Site are made directly with Slow the Spiral, not Shopify. Shopify is not responsible for any aspect of the sales between you and Slow the Spiral, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with us.
11. Disclaimer of Warranties
The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing on this Site constitutes medical, psychological, or therapeutic advice; our products and brand content (including references to breathwork or mindfulness) are intended for general wellness and lifestyle purposes only and are not a substitute for professional care.
12. Limitation of Liability
To the fullest extent permitted by law, Slow the Spiral and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to property damage, personal injury, lost profits, or loss of data, arising from your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or purchase of a product shall not exceed the amount you paid for the product(s) giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Slow the Spiral, its owners, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your misuse of any product purchased through the Site.
14. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased ("Dispute") shall be resolved exclusively through binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court.
No Class Actions: You agree that any arbitration will be conducted on an individual basis only, and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Arbitration Provider: Arbitration shall be administered by the American Arbitration Association under its applicable rules, with the arbitration to take place in Pinellas County, Florida, unless you and we agree otherwise.
Opt-Out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to slow the spiral.
This section survives termination of your use of the Site.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where the Federal Arbitration Act governs the arbitration provision above.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
